DESCRIPTION:As a method of procurement\, tendering can be fraught with risks. Errors in accepting or evaluating bids can result in legal liability on the part of the tendering authority.  Errors in the bid submitted in response to an Invitation to Tender can result in legal liability on the part of the bidder.  The law of tenders is complicated and constantly evolving as the courts and the construction industry adapt to new technology and evolving project delivery methods. \nCourse Outline: \n\nIntroduction to the law of tendering including an overview of:\n\n\nThe difference between tenders and RFPs and other procurement methods\nThe bidder’s obligations to the tendering authority\nThe tendering authority’s obligations to the bidder\n\n\nTendering case law update and discussion of recent decisions\nPractical tips and advice on key aspects of tendering\n\nPresenter: An Associate Counsel with SHK\, Marc MacEwing has practiced extensively as a construction lawyer in all aspects of the practice for over 30 years. He has particular expertise as a builders lien lawyer\, as well as in tendering disputes and preparing and analyzing contract documents. Marc advises owners\, contractors\, subcontractors\, material suppliers and design professionals. \nMarc has been listed in the Canadian Legal Lexpert Directory as a “repeatedly recommended” leading practitioner in construction law in BC.
